Classification — the HS code that decides duty
Classification is the assignment of a 10-digit HS code to each line in the consignment. The HS code determines the duty rate applied on import from a non-union origin and the regulatory treatment applied for any licence, conformity or safety obligation that may be triggered. Misclassification is the single most expensive problem a buyer can create on a merchandise shipment, because it converts a duty underpayment into a penalty plus interest plus the cost of a reassessment that takes weeks. The code is selected against the Harmonised System as adopted in the EAEU Common External Tariff, against the rules of interpretation and against the explanatory notes issued by the World Customs Organization and the EAEU itself for guidance. The supplier is the natural source of the classification because the supplier holds the composition and the weight per component; the buyer is responsible for confirming that the classification is plausible before the goods are declared.
